FIXMYSOLAR LLC
MEMBERSHIP TERMS AND CONDITIONS (FLORIDA)


1. Membership Services

During the active membership term, FixMySolar LLC (“Company”) agrees to provide the following services, subject to the limitations herein:

  • Remote system monitoring (where access is granted)

  • Remote troubleshooting assistance

  • Priority scheduling relative to non-members

  • Discounted service rates as defined in Exhibit B

  • Routine maintenance services (if included in selected plan)

Membership does NOT include repairs, parts, or onsite labor unless explicitly stated in Exhibit B.


2. Membership Term, Fees, and Activation

  • Membership is billed monthly and continues until canceled.

  • A non-refundable activation/setup fee applies.

  • Membership applies to a single system at a single property.

  • Additional systems require separate memberships.

Failure to maintain valid payment may result in suspension or termination of services.


3. Customer Responsibilities

The Member agrees to:

  • Provide full administrative access to system monitoring platforms (e.g., SolarEdge, Enphase)

  • Maintain internet connectivity required for monitoring

  • Respond to Company requests for photos, diagnostics, or approvals in a timely manner

Failure to provide monitoring access or requested information may delay service and void certain membership benefits.


4. Service Structure & Dispatch Policy

  • Remote troubleshooting will be attempted prior to dispatch whenever possible

  • Onsite service visits are subject to:

    • Dispatch/trip fees

    • Parts and labor charges

  • Membership discounts apply only after applicable service minimums are met

Company reserves the right to determine whether an issue requires onsite service.


5. Priority Scheduling

Members receive scheduling priority over non-members; however:

  • Priority scheduling does NOT guarantee same-day or next-day service

  • Service timing is subject to technician availability, weather, and parts availability


6. Routine Maintenance (If Applicable)

  • Must be scheduled in advance

  • Must be completed in a single visit

  • Does not roll over if unused

  • Subject to system accessibility and safety conditions


7. Third-Party System Disclaimer

The Company is not the original installer for most systems serviced.

Company is not responsible for:

  • Design defects

  • Installation errors

  • Code violations

  • Manufacturer defects

  • Existing roof damage or structural issues

Any such issues identified will be documented and may require separate corrective work.


8. Roof & Property Risk Acknowledgment

Member acknowledges:

  • Solar systems penetrate roofing systems

  • Pre-existing roof damage may be present

  • Service work may expose concealed conditions

Company is not responsible for leaks or damages caused by prior installation defects or pre-existing conditions.

Temporary waterproofing, if provided, is not a permanent repair.


9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW:

  • Company shall not be liable for:

    • Loss of energy production

    • Utility savings loss

    • Equipment downtime

    • Indirect, incidental, or consequential damages

  • Total liability shall not exceed:
    The total amount paid by Member in the preceding twelve (12) months


10. Warranty Disclaimer

Company warrants services will be performed in a professional and workmanlike manner.

No other warranties are provided, including:

  • System performance

  • Energy production

  • Equipment longevity


11. Termination

Either party may terminate with thirty (30) days notice.

  • No refunds for unused services

  • Activation fees are non-refundable


12. Automatic Billing

Membership automatically renews monthly.

Member authorizes Company to charge the payment method on file.

Failure of payment may result in:

  • Suspension of services

  • Cancellation after thirty (30) days


13. Force Majeure

Company shall not be liable for delays caused by events beyond its control, including:

  • Hurricanes, tropical storms, or severe weather

  • Supply chain disruptions

  • Utility outages

  • Manufacturer delays

  • Labor shortages


14. Governing Law

This Agreement shall be governed by the laws of the State of Florida.

Venue shall lie exclusively in:
Palm Beach County, Florida


15. Assignment

Member may not assign this Agreement without written consent.

Company may assign freely.


16. Entire Agreement

This Agreement constitutes the entire understanding between the parties.


Exhibit A – Definitions (Condensed)

Performance Issue: Verified system malfunction, not weather-related fluctuation

Remote Troubleshooting: Non-physical diagnostics only

Routine Maintenance: Inspection, testing, and cleaning performed in a single visit
